Petitioner is aggrieved by the fact that in spite of several complaints being filed with the police authorities no action has been taken.

Records reflect that petitioner has already approached the jurisdictional magistrate by invoking its power under Section 175(3) of the BNSS, 2023. Learned Magistrate has fixed a date on 15th of January, 2025 for submission of police report and for consideration of the prayers advance by the petitioner. Learned advocate appearing for the State has submitted the report which reflects that already police authorities have registered Rajganj Police Station Case

no. 10/2025 dated 09.01.2025 under the relevant provisions of law.

In view of the learned Magistrate already in seisin of the issue, this Court leaves it to the discretion of the learned Magistrate to exercise its powers, in the meantime police authorities would keep a strict vigil so that there is no breach of the peace at the locale and/or any untoward incident arises because of the strained relationship existing between the petitioner and the private respondents.

The purpose for which the present writ petition has been preferred as the same has been sub-served. Further pendency of the writ petition is unwarranted. With the aforesaid WPA 51 of 2025 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
