1. The affidavit of service is kept with the record.

2. The petitioner is aggrieved by the inaction of the respondents in granting permission to hold a meeting organized by BJP.

3. It appears that the application made by the concerned committee who is organizing the meeting, is totally devoid of any details. Thus, the Court has no other option, but to restrict the meeting with certain terms and conditions:- a) The meeting will be organized by the Bharatiya Janata Party under the Cooch Behar District Committee at Pundibari.

The same shall be held between 12.00 noon to 3.00 p.m. on January 9, 2026.

b) The meeting will be held on Dag No.401, Mouza - Chhagalber, J.L. No.38, Police Station - Pundibari, under Gopalpur Gram Panchayat, District - Cooch Behar, on the basis of the no objections granted by the landowners.

c) Not more than 15 loud speakers shall be used. The sound limit shall be maintained.

d) Not more than 3,000 people will be permitted to attend the meeting.

e) The list of volunteers who have been mentioned in pages 22 and 23 of the writ petition shall approach the concerned police station immediately, with their I.D. Cards.

f) No political rally and procession will be held in the streets and there will be no disruption to the traffic.

g) No sticks, swords or lathis, etc., shall be permitted to be carried by the participants.

h) The meeting will be held peacefully.

i) In case of any untoward incident or breach of law and order, the police authorities shall take appropriate steps.

4. The State respondents will act on the basis of the learned Advocate's communication.

5. Accordingly, the writ petitioner is disposed of.

6. The parties are directed to act on the basis of the server copy of this order.
