... ... Applicant Mr. Kallal Ghosh ... ... for applicant Mr. Ujjal Luksom, Mr. Sagnik Sankar Sikdar .... for State. Mr. Ghosh, learned advocate appears on behalf of applicant seeking anticipatory bail in connection with Mekhliganj Police Station Case no.242 of 2019 dated 22.10.2019 under sections 448/376/506 of Indian Penal Code. He submits, his client was not with defacto complainant / alleged victim on 15th September, 2019, alleged to be date of incident. That can be verified. Mr. Luksom, learned advocate appears on behalf of State and hands up case diary to draw attention to pages 21, 44 and 11 being, inter alia, statement made under section 161 of Code of Criminal Procedure of father of accused and statement made under section 164 of the victim.
It appears, there has been some association by accused with victim. We are not inclined to grant anticipatory bail. (Arindam Sinha, J.) (Biswajit Basu, J.)
