1. Apprehending arrest in connection with Matigara Police THURSDAY COURT : 01 ITEM : 03 MATTER : 438 STATUS : ALLOWED BENCH ID : 1482 TRANSCRIBER : NANDY Station Case No. 646 of 2023 dated 09.08.2023 under Section 306/34 of the Indian penal Code, the petitioner has filed the instant application for anticipatory bail.
2. It is an unfortunate case where a lady committed suicide after writing a suicidal note which was recovered by the Investigating Officer. In order to eradicate any confusion on the genuinity of the said suicidal note, the undisputed document was also taken into custody and was sent for opinion of a Handwriting Expert. It is submitted that the handwriting expert opined that the writing in the suicide note matches with the undisputed documents of the victim lady and subsequently charge-sheet is also filed on 05.03.2025 vide CS-439(i)/25.
3. Undisputedly, the lady committed suicide by leaving a
P a g e | 2 suicide note indicating the role of the present petitioner attributable to it. After the investigation was made, the charge-sheet has already been submitted and as indicated hereinabove, a supplementary charge-sheet is submitted recently after obtaining the handwriting expert's report.
4. Apparently, we find that the lady was in deep love relationship with the petitioner and have side away from the earlier friend with whom she had a love relationship. She disclosed the role of the petitioner who subsequently started detaching himself from her. Both the petitioner and the victim lady are major and capable to take a decision for physical relationship. The petitioner is commissioned in the Army and holding a responsible post and, therefore, we do not think that the petitioner would abscond and will not be able to attend the trial.
5. Taking into account that charge-sheet and also the supplementary charge-sheet have already been submitted, there is no point of any custodial interrogation as the prosecution has to prove the case on the basis of the evidence to be produced at the time of trial.
6. We, therefore, allow the prayer for anticipatory bail.

Accordingly, We direct that in the event of arrest, the petitioner, namely RANADEEP HALDER, shall be released on bail upon furnishing a bond of Rs. 20,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita and shall not enter into the territorial jurisdiction of the Mirik and Matigara Police Stations until the charge-sheeted witnesses are examined
