Mantu Sen v. State Of West Bengal
15.01.2020.
as (Rejected) C.R.M. 520 of 2020 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 09.01.2020 in connection with Dinhata P.S. Case No.431 of 2019 dated 06.10.2019 under Sections 341/323/325/506/34 of the Indian Penal Code and added Sections 326/307 of the Indian Penal Code. In the matter of : Mantu Sen.
... Petitioner.
Mr. Pronojit Roy.
...for the Petitioner.
Mr. Antarikhya Basu.
.....for the State.
Heard the learned Advocates appearing for the parties. It is submitted on behalf of the petitioner that he has been falsely implicated in the instant case.
Learned Advocate appearing for the State opposes the prayer for anticipatory bail and submits that the petitioner was a member of group of persons who had mercilessly assaulted the victim resulting in grievous injury.
Having considered the materials on record and keeping in mind the prima facie involvement of the petitioner in assaulting the victim causing grievous injury including amputation of finger, we are of the opinion that this is not a fit case to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
