Learned counsel for the petitioner submits that commercial quantity of ganja was recovered from the co-accused Mr. Rohit Yadav by Mathabhanga Police Station on 6th November, 2025.

Learned counsel submits that the present petitioner was arrested on the basis of the statement of the co-accused, Rohit Yadav and no recovery was effected from the this person. Learned Counsel for the State has opposed the prayer for bail application and submits that the investigation is still in progress.

However, learned counsel for the State has fairly submitted that so far no recovery has been effected from the present petitioner and so far no other connecting offence has

surfaced, thus taking into the facts and circumstances of the case, the petitioner, viz. Gajendra Singh is released on bail of Rs. 10,000/- with two sureties of the like amount, one of whom must be local, to the satisfaction of the learned Additional Sessions Judge, 1st Court (NDPS), Cooch Behar, subject to the condition that the petitioner shall appear before the learned Trial Court even every date of hearing until further orders. The petitioner shall not threaten, tamper or intimidate the complainant or members of the family in any manner or whatsoever commit similar offence in future. The petitioner shall not leave to the jurisdiction of the learned Trial Court until further orders. In case the petitioner violates any such condition the prosecution is at liberty to move an application for cancellation of bail.

The application for bail is allowed.

C.R.M. (NDPS) 43 of 2026 stands disposed of.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
