The petitioner is an Assistant Teacher at Dewanganj High School ( Bengali Medium), Coochbehar. He prayed for general transfer through Utsashree Portal in the year 2021. However, the application was not considered on the ground that there was a criminal case pending against the petitioner. By an order dated 26.9.2024 passed by the learned Additional Sessions Judge, Mekhliganj, Coochbehar in S.C. No. 118 of 2022, the petitioner was acquitted of all charges. Now he wants to make a further application for transfer before the concerned authority.

Learned counsel appearing for the Central School Service Commission submits if an appropriate application is made, the same will be considered in accordance with law. In view of the above, petitioner is granted liberty to pray for transfer before the concerned authorities in accordance with law. If the same is made within two weeks before the

school authorities, the latter shall forward the matter before the D.I. of Schools who shall, in turn, refer the matter to the Central School Service Commission within four weeks from receipt of necessary papers and the Commission shall consider in accordance with law.

With these observations, the writ petition is disposed of. As affidavits were not called for, the allegations made are deemed not to have been admitted.
