Ananta Kumar Barman @ Ananta Barman v. State Of West Bengal
16.01.2020 Court No.28 Sl No.52 AP CRM 577 of 2020 In Re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 14.01.2020 in connection with Dinhata P.S. Case No.475 of 2019 dated 05.11.2019 under Sections 441/326/307/34 of the Indian Penal Code. And In Re: Ananta Kumar Barman @ Ananta Barman ... ... Petitioner.
Mr. Pronojit Roy ... for the petitioner.
Ms. Faria Hossain, Ms. Baisali Basu ... ... for the State.
It is submitted on behalf of the petitioner that he is a school teacher and has been falsely implicated in the instant case due to political rivalry.
Learned lawyer for the State opposes the prayer for anticipatory bail and refers to the injury report of the victim. Having considered the materials on record and in view of the fact that the petitioner appears to be the principal assailant who inflicted fracture injury upon the victim, we are not inclined to grant anticipatory bail to the petitioner.
The application for anticipatory bail is, thus, rejected. (Suvra Ghosh, J.) (Joymalya Bagchi, J.)
