For the State The petitioner's grievance is that the petitioner is a handicapped person with about 60 per cent disability. Pursuant to an advertisement issued by the Officer-inCharge, Jalpaiguri Polytechnic Institute for filling up the vacant post of Mess Employees for ladies hostel in the said institute, the petitioner appeared and stood first. The panel was published on 31st October, 2012. It is the further case of the petitioner that till date no appointment letter has been issued and, as such, the petitioner prays for a direction for issuance of appointment letter.
The petitioner though has approached this Court after about eight years from the date of publication of the panel, yet considering the fact that the petitioner is a handicapped person, I make a departure from the
rigours of delay that may be applicable and direct the Director, West Bengal Council of Technical and Vocational Education and Skill Department, being the respondent no.2, to consider the petitioner's case treating the writ petition as the petitioner's representation. The respondent no.2 shall give a personal hearing to the writ petitioner and pass a reasoned order on the issue of appointment as claimed by the writ petitioner. The entire exercise has to be completed within a period of six weeks from the date of communication of a server copy of this order. The writ petition is disposed of accordingly. There shall be no order as to costs.
