1. The petitioner is represented by his learned counsel.

2. None appears on behalf of the opposite party.

3. By filing this instant revisional application under Section 24 of the Code of Civil Procedure, the petitioner/wife has prayed for transfer of the case record of Matrimonial Suit No.581 of 2025 from the file of learned Additional District Judge, Baruipur, South 24 Parganas to the Court of learned District Judge, Jalpaiguri.

4. At the time of hearing, learned advocate appearing on behalf of the petitioner/wife submits before this Court that it is the specific case of the petitioner that at present, he is residing in District - Jalpaiguri at her paternal home on account of some matrimonial discord. It is further submitted that being a resident of Jalpaiguri, the petitioner/wife is facing difficulty to go to Baruipur Court for contesting the aforementioned suit.

5. It is, thus, submitted that appropriate relief/reliefs may be granted to the petitioner/wife in terms of the prayers made in the instant petition.

6. In absence of any opposition and on careful perusal of the entire materials, as placed before this Court, this Court is of the considered view that the petitioner/wife is successful in making out a case for transfer of the case records of the aforementioned suit, as prayed for.

7. Accordingly, prayer is considered and allowed.

8. Consequently, the case record of Matrimonial Suit No.581 of 2025 stands hereby withdrawn from the file of learned Additional District Judge, Baruipur, South 24 Parganas with immediate effect and the same be placed in the file of learned District Judge, Jalpaiguri for trial and disposal.

9. Learned District Judge, Jalpaiguri is hereby directed to take up hearing of Matrimonial Suit No.581 of 2025 either by himself or he may transfer the case record of the aforementioned suit to any other Additional District Judge and/or Fast Track Court in Jalpaiguri.

10. Liberty is given to the learned advocate on record for the petitioner/wife to communicate the server copy of this order to the learned Additional District Judge, Baruipur, South 24 Parganas as well as to the learned District Judge, Jalpaiguri. The

Presiding Officers of the said two Courts are directed to act on the server copy of this order.

11. In addition, the Department is directed to communicate this order both to the Court of learned Additional District Judge, Baruipur, South 24 Parganas as well as to the Court of Learned District Judge, Jalpaiguri for their information and compliance.

12. With the aforementioned observation, C.O. 2 of 2026 is disposed of.

13. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
