..Advocate for the respondents present in Court Prayer made in the present petition is for denovo or further investigation of the criminal case registered on account of death of son of the petitioner. It is not in dispute that charge sheet has already been filed.

In view of the aforesaid fact, learned counsel for the petitioner submitted that he may be permitted to withdraw the petition with liberty to file appropriate application before the learned Magistrate seeking further investigation in the case in terms of Section 173(8) Cr. P.C., as according to him material evidence has not been collected by the investigating agency. The writ petition is, accordingly, disposed.
