1. The reasoned order dated 21st August, 2024 rejecting the prayer of the petitioner for transfer on the ground that the petitioner is a single teacher in the subject is impugned herein.

2. Learned advocate for the petitioner relies on the notification of the School Education Department, Secondary Branch being no. 09-SE/SE/S/IS-04/95(Pt III) dated 3rd January, 2022 wherein there is a provision for transfer of single teacher.

3. Prayer has been made to direct the School authority to take steps to decide the prayer of the petitioner in terms of the said notification.

4. On a perusal of the impugned order, it appears that the Commissioner of School Education rejected the prayer of the petitioner without taking into consideration the notification dated 3rd January, 2022.

5. In view of the above, the instant writ petition is disposed of by granting leave to the petitioner to make fresh

application before the School Managing Committee disclosing all facts.

6. In the event such a representation for transfer is made, then the same shall be considered by the School Managing Committee in light of the above notification dated 3rd January, 2022.

7. The writ petition stands disposed of.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
