1. Two grounds are canvassed for grant of bail. One ground is the medical condition and the other is the period of detention.

2. So far as the medical condition is concerned, report was called for by the co-ordinate Bench which was submitted.

3. Medical report does not disclose anything alarming so far as the petitioner No. 1 is concerned. Claim was that the petitioner No. 1 was suffering from cancer. Medical report does not establish it to be so.

4. Period of detention coupled with the gravity of the offence with which the petitioners are charged with, do not inspire confidence in invoking Article 21 of the Constitution of India in favour of the petitioners at this stage.

5. Commercial quantity of narcotic was seized from the joint possession of the petitioners.

6. Petitioners are unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

7. Consequently, prayer for bail of the petitioners is rejected.

8. CRM(NDPS)/48/2026 is dismissed.
