1. In view of the subsequent development i.e. taking over physical possession of the secured assets, the appeal and the writ petition has become infructuous.

2. Accordingly appeal is disposed of observing it shall be open to the appellant borrower to negotiate with the bank and arrive at a one-time settlement as per relevant rules.

3. Pendency of any negotiation however shall not stand in way of the respondent bank to pursue its remedies in accordance with law.

4. CAN 1 of 2025 is disposed of.
