The petitioner states that he was appointed as a guest teacher in Life Science at Government Model School, Phansidewa, Darjeeling on 4th February, 2020 and worked in the said school till 31st January, 2023.

The grievance of the petitioner is that the respondent authority has not paid the benefits to the petitioner in terms of the Memo No.6472-F(P) dated 2nd December, 2019.

The learned advocate the petitioner submits that though the other similarly situated teachers have got benefit in terms of the Memorandum dated 2nd December, 2019 but the petitioner is being discriminated against. He further submits that the petitioner has submitted a representation dated 4th December, 2023 which is still pending.

In view thereof, this writ petition is disposed of by directing the Commissioner of School Education, being the 2nd respondent herein, to consider the representation dated 4th December, 2023 and to dispose of the same by passing a reasoned order upon giving an opportunity of hearing to the petitioner or his authorized representative and communicate the same to the petitioner immediately thereafter.

The entire exercise shall be completed within a period of six weeks from the date of receipt of the server copy of this order.

In the event the decision of the authority is in favour of the petitioner, such authority shall take all consequential steps thereafter in accordance with law.

There shall be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
