Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been implicated in connection with the present case on the basis of statement of co-accused.

Learned advocate appearing for the State, on the other hand, opposes the prayer for anticipatory bail and submits that there are different witnesses implicating the present petitioner.

Since there has been no recovery from the possession or any hide outs of the present petitioner and further investigating agency could not establish any relationship by way of CDRs or monetary transactions, I am of the view that

custodial detention of the present petitioner may not be warranted in the facts and circumstances of the case. As such, the prayer for anticipatory bail of the petitioner is allowed.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, petitioner shall meet with the Investigating Officer of the case on and from 16th January, 2026 once in every ten days till the charge-sheet is submitted before the jurisdictional court. The application for anticipatory bail, being CRM (A) 22 of 2026, is, thus, disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
