No. 770/18 dated 7th November, 2018 under Sections 20(b)/25 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

We have heard learned advocates for the parties and perused the materials in the case diary.

Having regard to the nature of accusation and the gravity of offence alleged to have been committed by the petitioner together with the quantity of 'ganja' that was recovered from the subject truck of which he was one of the occupants, we are not inclined to exercise discretion in his favour notwithstanding the fact that he is in custody for 140 days.

Accordingly, C.R.M. 60 of 2019 is rejected.
