This is an application wherein the petitioner has prayed for expeditious disposal of the complaint case filed under Section 138 of the N.I. Act 1881 being C.R. case no. 1360 of 2022, presently pending before the learned Judicial Magistrate, 3rd Court, Siliguri.

On perusal of the prayer made in the application, it appears that the prayer is innocuous and if it is allowed, the opposite parties will have no cause to prejudice and as such, service of copy of the application upon the opposite parties is dispensed with.

Since this is a complaint case under Section 138 of the N.I. Act which was filed in the year 2022 and is pending for about three years, I find that the prayer made by the petitioner

in the instant application is justified and required to be allowed for the ends of justice.

In view of above, CRR 23 of 2025 is hereby disposed of with a direction upon the court below to take every endeavour for expeditious disposal of the complaint case being C.R. case no. 1360 of 2022 and to make his best efforts to conclude the entire proceeding preferably within a period of six months from the next date of hearing.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
