Affidavit-of-service be kept with the record. The petitioner is widow of one Ananda Barman @ Anandamohan Barman who died in harness on 2nd April, 1989 while working as Town Chowkidar under Town Committee of Mekhliganj Municipality. After his death the Municipality was genius enough to provide service on compassionate ground to one of the sons of the deceased employee.

In the instant writ petition, the petitioner has prayed for releasing her family pension and terminal benefit in favour of her on account of death of her husband.

The learned Advocate for the State of West Bengal is present.

Mekhliganj Municipality is not represented.

However, considering the nature of prayer and entitlement of the petitioner, I am inclined to allow the instant writ petition. the respondent No.4 is directed to release the family pension and terminal benefit in favour of the petitioner on account of the death of Ananda Barman @ Anandamohan Barman while working as Town Chowkidar under Town Committee of Mekhliganj Municipality within three weeks from the date, if the Bengal Municipality Acts and Rules framed thereunder permits.

The instant writ petition is, accordingly, disposed of on contest, however, without costs. (Bibek Chaudhuri, J.)
