13-01-2022 (ct. no.1) KOLE Circuit Bench of Calcutta High Court At Jalpaiguri CRM (NDPS) 8 of 2022 In re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with Matigara Police Station Case No. 17 of 2020 dated 21.02.2020 under Sections 21(c)/22(c) of the NDPS Act.

- A n d - In the matter of : Dinesh Singh @ Munna Bhai .... Petitioner.

Mr. H. Rahaman, ... For the Petitioner.

Mr. A. Sankar Chakraborty, Ld. APP, Mr. S. Ganguly, ... For the State.

Commercial quantity of narcotic substances was recovered from the petitioner. His bail prayer was rejected by a coordinate bench by an order dated September 15, 2021 passed in CRM 934 of 2021.

The State opposes the prayer for bail.

We find no change in circumstances since the rejection of his prayer for bail. Also in view of the restrictions in Section 37 of the Narcotic Drugs and Psychotropic Substances Act, we are not inclined to allow the present application for bail. However, in view of the fact that the petitioner is in custody for about 687 days, we request the learned Trial Court to expedite the trial to the extent the business of the Court may permit and bring the same to its logical conclusion at an early date

and preferably within one year from resumption of normal functioning of the Court.

The application, being No. CRM (NDPS) 8 of 2022 is accordingly disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Aniruddha Roy, J. ) ( Arijit Banerjee, J. )
