Snehlata Minj v. The States Of West Bengal And ORS
JPD-01 04.02.2026 Court No.18 pg.
IN THE HIGH COURT AT CALCUTTA
CIRCUIT BENCH AT JALPAIGURI CONSTITUTIONAL WRIT JURISDICTION (From the Principal Bench) WPA 82 of 2026 Snehlata Minj -VsThe State of West Bengal & Ors.
Mr. Shamim Ul Bari ...For the Petitioner Mr. Nabankur Pal (vc) ... For the State Mr. Rahul Kumar Singh (vc) ... For the WBCSSC 1.
The petitioner is aggrieved by the rejection of her candidature in 2nd State Level Selection Test on the ground that the medium of school opted by her has not been studied in any level.
2.
The petitioner has annexed document in the writ petition in support of the submission that she studied Bengali till the level of Class VIII as third language. The first language of the petitioner is Hindi which is the subject she applied for and she does possess post graduate degree in the said subject. 3.
Submission of the petitioner is that there is no concept of third language in the secondary level examination and, accordingly, the authority cannot ask for the said degree at the secondary level stage. 4.
The notification pursuant to which the recruitment process is being conducted mentions the requisite eligibility criteria for appointment. In respect of Classes XI and XII, a candidate willing to be selected as an assistant teacher having Bengali or Hindi as the medium of instruction shall have to pass the said
subject as first or second or third language at the secondary level examination conducted by the Board. 5.
In the instant case, the petitioner applied for teaching the subject 'Hindi' in a Bengali medium school. Though the petitioner possesses the post graduate qualification in the subject 'Hindi', but she does not have the qualification of Bengali in the secondary level examination. She has learnt Bengali only till the level of Class VIII.
6.
As the petitioner does not appear to fulfil the educational qualification required for appointment, the authority rightly cancelled the candidature of the petitioner.
7.
The cancellation does not call for any interference.
8.
The writ petition fails and is hereby dismissed.
9.
