Mr.
Ghosh, learned advocate representing District Primary School Council, Alipurduar, on instructions submits that though vide Memo dated 3rd November, 2022 petitioner was asked to appear before the Chairman, District Primary School Council, Alipurduar, on 9th November, 2022 but it is fact that in spite of appearance of the petitioner before the Chairman on the particular date and time no decision could be taken on the prayer of the petitioner for granting appointment on compassionate ground. However, it has been
fairly submitted on behalf of District Primary School Council, Alipurduar, that in the event of a direction be passed on this writ petition necessary steps shall be taken to take decision on the claim of the petitioner for appointment on compassionate ground.
Accordingly, the writ petition stands disposed of by directing the Chairman, District Primary School Council, Alipurduar, being the respondent no. 2 to take decision on the entitlement of the petitioner to be appointed on compassionate ground within a period of six weeks from the date of communication of this order by passing a reasoned order after granting opportunity of hearing to the petitioner or his representative. The decision to be taken by the Chairman shall be communicated to the petitioner within one week thereafter.
There shall be no order as to costs.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
