D/L 271 February 3, 2023 MNS Calcutta High Court In The Circuit Bench at Jalpaiguri Appellate Side CRM (A) 34 of 2023 In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 05.01.2023 in connection with Siliguri Police Station Case No. 551 of 2021 dated 06.06.2021 charge sheeted under Sections 363/366/370/370A/372/373/120B of the Indian Penal Code, 1860 and 3/4/5/6/7/9 of Immoral Trafficking (Prevention) Act, 1956.

And In the matter of: Smt Nilam Mahato @ Neelam .... petitioner Mr. Joyjit Chowdhury, Mr. Rohit Agarwal ... for the petitioner Mr. Saikat Chatterjee, Mr. Dhiman Sil ... for the State Learned counsel for the petitioner submits that the FIR was registered about 4-5 years back for the alleged offence. Moreover, all the co-accused persons have already got benefit of bail or anticipatory bail.

Learned counsel for the State opposes the prayer for anticipatory bail.

However, being satisfied that there is sufficient ground to grant anticipatory bail, CRM (A) 34 of 2023 is allowed, thereby granting anticipatory bail to the petitioner on condition that the petitioner shall satisfy the stipulations in Section 438(2) of the Code of Criminal Procedure.

In the event of arrest, the petitioner shall be released on bail upon furnishing bond of Rs.5,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Siliguri. The petitioner shall not leave the territorial jurisdiction of the concerned police station during the entire period of investigation and shall cooperate with the investigation.
