No. 10 of 2019 dated 3rd February, 2019 under Sections 448/427 of the Indian Penal Code read with Sections 4/10 of the Protection of Children from Sexual Offences Act, 2012 by filing this application under Section 439 of the Code of Criminal Procedure, 1973.

We have heard learned advocates for the parties and perused the materials in the case diary, more particularly, the statement of one of two minor victims recorded under Section 164 of the Code of Criminal Procedure. We are of the opinion that this is not a fit and proper case to enlarge the petitioner on bail and accordingly, C.R.M. 109 of 2019 is rejected at this stage.
