AoR for the petitioner Mr. Hirak Barman Mr. Momenur Rahman ... for the State The writ petitioner was not successful in the process of recruitment for the post of Home Guard conducted by the Superintendent of Police (Home Guard) cum Chairperson of the Screening Committee, Cooch Behar, being the respondent no.4. It is submitted that the recruitment process was initiated pursuant to the notice dated 20th February, 2013 but the results were published only in the year 2020.

Counsel for the petitioner argued that it was only informed by the respondents that the petitioner did not qualify for the aforesaid recruitment process although he participated in the same.

It is further submitted that the respondents have not given any reason why the petitioner did not qualify or that the marks obtained by the petitioner as opposed to be cutoff marks.

A report has been filed by the respondents.

The marks obtained by the petitioner have been clearly indicated in paragraph 6 at page 5 of the said report.

The writ petitioner appears to have secured far way below the cutoff marks.

Counsel for the petitioner argued that the cutoff marks have been supplied by the respondents by a notification dated 23rd December, 2017. It appears from the said notification that the notification was introduced to cover all pending recruitment processes that are to be held in future. In that view of the matter no relief can be granted to the writ petitioner. The writ application is devoid of any merit and hence the same is dismissed.

Interim order, if any, shall stand vacated.

There shall be no order as to costs.
