Haradhan Sarkar v. Narcotic Control Bureau
16.01.2026 Item no. 06.
Court No.3.
Rakib (Rejected) In the High Court at Calcutta Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction CRM (A) 27 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with NCB Crime No. 08/NCB/SLG/2024 dated 12.12.2024 under Sections 8(c) of the NDPS Act.
And In the matter of : Haradhan Sarkar.
......Petitioner.
Mr. Hillol Saha Podder ......for the Petitioner.
Mr. Sudipto Kr. Majumder, Ld. DSGI Mr. Sudip Kr. Paul ......for the NCB.
Learned DSGI, appearing for the NCB on instruction submits that petitioner has already been declared as proclaimed offender and the seizure which has been effected is of commercial quantity.
Having considered the same, I am of the view that this is not fit case for granting anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner in CRM (A) 27 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
