AoR for the petitioners Mr. Subir Kumar Saha Mr. Momenur Rahman ... for the State The writ petitioners are aggrieved by the fact that the order dated 19.09.2006 passed by the Child Development Project Officer, Cooch Behar-I, Integrated Child Development Scheme Project, Cooch Behar has not been carried further by the State.

The said order itself was passed by the aforesaid Child Development Project Officer, Cooch Behar-I, pursuant to the direction dated 14th January, 2020 passed by a Co-ordinate Bench of this Court in W.P. No. 13 (W) of 2020. In the said order, it is recorded that in view of the interim order dated 28th January, 2020 passed in W.P.A. No. 820 of 2019, selection and recruitment of Anganwadi Helpers initiated in the year 2009 could not be made any further.

It is submitted by the Counsel for the State that the District Selection and Monitoring Committee, Cooch Behar, does not exit any further in view of change of two members.

This Court notes that since W.P.A. No. 820 of 2019 was dismissed on 22nd September, 2021, all interim orders have been vacated.

There is no impediment in completing the recruitment process of Anganwadi Helpers initiated in the year 2009.

In that view of the matter, the Principal Secretary, Department of Women & Child Development & Social Welfare being the respondent no.2 shall constitute the District Selection and Monitoring Committee, Cooch Behar afresh and complete the process of appointment of Anganwadi Helpers in Child Development Project Officer, Cooch Behar-I, Integrated Child Development Scheme Project, Cooch Behar, more fully described and elaborated in the order dated 13th October, 2020.

In the event, all the vacancies have been filled up in accordance with law, the available/empanelled candidates shall be considered against the vacancies that may arise in future.

This is subject to any Rule of the State, as regards filling up of any category of vacancies. For the aforesaid purpose, the writ petitioners shall serve a copy of this order along with a copy of the instant writ petition on the respondent no.2 herein.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
