Learned advocate appearing for the petitioner submits that the present petitioner has been implicated in connection with the instant case on the basis of statement of co-accused and there has been no recovery from the present petitioner. Further two of the other accused persons viz. Goutam Karmakar and Aminur Hossain have been granted anticipatory bail.

Learned advocate appearing for the State, on the other hand, opposes the prayer for anticipatory bail and submits that W/P/A has already been issued by the learned Special Court. The case is of the year 2023 and the petitioner has been evading the process of law.

Having considered that the petitioner has been implicated on the basis of statement of co-accused, I am

inclined to extend the privilege of anticipatory bail to the petitioner. As such, the prayer for anticipatory bail of the petitioner is allowed.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date. Learned Trial Court would thereafter take steps in accordance with law.

The application for anticipatory bail, being CRM (A) 30 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
