CIRCUIT BENCH AT JALPAIGURI CRIMINAL MISCELLANEOUS JURISDICTION CRM (M) 20 of 2026 In Re : An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Mekhliganj Police Station Case No. 148 of 2025 dated 17/5/2025 under Sections 103(i)/239/3(5) of the BNS.

The petitioner is in custody for more than 200 days and prays for bail.

Learned counsel for the petitioner submits that the case is based on circumstantial evidence. There is no eye witness. The petitioner has been falsely implicated.

Learned counsel for the State opposes the prayer. I have considered the material on record.

The petitioner is the grandson of the victim who was murdered. It is a fact that there is no eye witness to the incident. However, the offending weapon has been recovered pursuant to the leading statement of the petitioner. The petitioner is in custody for about 200 days. Offence, if proved, shall attract mandatory life imprisonment.

Considering the material on record and gravity of the offence, prayer for bail is rejected at this stage.

CRM (M) 20 of 2026 is disposed of.
