Amir Ali v. The State Of West Bengal
14.01.2022 Item no.25.
Court No.01.
S. De (Rejected) (Via Video Conference) Circuit Bench of Calcutta High Court at Jalpaiguri CRM (NDPS) No. 17 of 2022 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure filed on 11.01.2022 in connection with Kotwali Police Station Case No. 776 of 2021 dated 01.08.2021 under Sections 21(C)/29 of the N.D.P.S. Act.
And In the matter of : Amir Ali.
......Petitioner.
Mr. Hillol Saha Podder, ......for the petitioner.
Mr. Arun Kr. Sarkar, Ms. Namrata Das ......for the State.
Allegedly, commercial quantity of contraband items was seized from the petitioner. In view of the restriction in Section 37 of the Narcotic Drugs and Psychotropic Substances Act, we are not inclined to allow the petitioner's prayer for bail. The petitioner says that he is in custody for 196 days. The State says that charge-sheet is yet to be submitted. We are a little surprised. The State should expedite the filing of chargesheet and thereafter the learned Trial Court is requested to expedite the consideration of charges and to bring the trial to an early conclusion to the extent the business of the Court may permit.
Accordingly, the application for bail is rejected. C.R.M. (NDPS) 17 of 2022 is dismissed.
