For the Petitioner The petitioner is aggrieved by the fact that his prayer for confirmation of the interim bail has not been considered by the learned Special Judge, 1st Court, Darjeeling, despite the petitioner appearing before the learned Court on several occasions.

It appears that by an order passed on 30th August, 2025, the petitioner was released on interim bail which was extended from time to time. The petitioner has sought confirmation of the interim bail before the learned Special Judge which has not been considered.

In view of the fact that the petitioner has been released on interim bail which is being extended from time to time and in view of the pendency of the application seeking confirmation of the interim bail, the learned Additional District Judge, 1st Court, Darjeeling cum Special

Judge is directed to consider and dispose of the application filed by the petitioner seeking confirmation of the interim bail upon granting reasonable opportunity of hearing to the investigating officer, in accordance with law, preferably on the next date fixed by the learned Trial Court or within a fortnight thereafter.

CRR 26 of 2026 is accordingly disposed of.
