This is a second criminal revision preferred against an order passed by the learned District and Sessions Judge, Jalpaiguri on January 4, 2018 in criminal revision No.85 of 2018.

In view of the provision laid down under Section 397 (3) of the Code of Criminal Procedure 1973, the present case cannot be entertained, being not maintainable.

Accordingly, CRR No.28 of 2019 be dismissed.

Urgent photostat certified copy of this order, if applied for, shall be given to the parties upon compliance of usual formalities.
