On the complaint of the petitioner Sitalkuchi P.S Case No.353 of 2023 dated October 28, 2023 under Sections 363, 365, 376 and 109 of the Indian Penal Code has started against the private respondent nos.5 to 9.
The petitioner is complaining lapses in the investigation.
A Co-ordinate Bench of this Court by the order dated January 29, 2024 had directed the State to file a report regarding the progress of the said investigation.
Ms. Bose, learned Advocate for the State respondents files such report today, let it be kept with the record.
It appears from the said report that except the principal accused the respondent no.5 herein, others are on bail and the principal accused since is avoiding arrest the Investigating Officer has prayed before the learned Additional Chief Judicial Magistrate, Mathavanga for proclamation and attachment.
The report suggests that there is substantial progress in the investigation, as such further direction at this stage is not necessary.
WPA 132 of 2024 is disposed of with the above observations, there shall be however no order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
