Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. She is only the second wife of the husband of the alleged victim. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that although the case was started in November, 2004, the petitioner is praying anticipatory bail in 2026. He relies on the postmortem report, the statements of other witnesses and a dying declaration of the victim implicating the present petitioner as the one who had poured the kerosene oil and set the victim on fire.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner.

The application for anticipatory bail of the petitioner is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
