Learned counsel for the petitioner submits that after his prayer for anticipatory bail was turned down, other co accused standing on the same footing as the petitioner, have been granted bail.

Learned counsel for the State submits that charge sheet has been submitted. The name of the petitioner has transpired from the statement of the co accused.

I have considered the material on record.

It is a fact that the co accused similarly circumstanced with the petitioner has been granted bail after the petitioner's prayer for anticipatory bail was rejected. No recovery has been made from the

petitioner. His name has transpired from the statement of the co accused. The petitioner has been able to rebut the statutory restriction under Section 37 of the NDPS Act. He is entitled to anticipatory bail.

Accordingly, this Court directs that in the event of arrest, the petitioner Narayan Barman be released on bail on furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall surrender before the jurisdictional Court and pray for regular bail within two weeks from date.

CRM (A) 37 of 2026 is, thus, disposed of.
