The petitioner is aggrieved by the observation of the Special Land Acquisition Officer, Coochbehar recorded in the order dated November 23, 2022 mentioning that as plot no. 1564 is not recorded in favour of the petitioner Manik Roy Sarkar he will not be entitled to receive compensation for acquisition of the same.

The petitioner has annexed the copy of the record of rights in respect of plot no. 1564 which appears to have been recorded in favour of the petitioner Manik Roy Sarkar.

The petitioner submits that as the record of rights in respect of plot no. 1564 is recorded in his favour, accordingly, he is entitled to receive compensation on account of acquisition of the said plot of land.

The petitioner is directed to forward to the Special Land Acquisition Officer a copy of the record of rights in respect of plot no. 1564 and the copy of the order passed by this Court in WP 3622 of 2018 on September 23, 2021 and copy of the order sheet dated November 23, 2022 in respect of the subject proceeding for taking necessary consequential steps in the matter.

The Special Land Acquisition Officer may give an opportunity of hearing to the petitioner.

Necessary consequential steps shall be taken in the matter by the Special Land Acquisition Officer at the earliest, but positively within a period of eight weeks from the date of communication of this order. The writ petition stands disposed of.

Affidavit of service filed in Court today is taken on record.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
