The petitioner has filed supplementary affidavit which is a changed circumstance and additional grounds to the reasons so assigned earlier by the competent authority particularly relating to the factum of petitioner having been divorced and not being entitled to any pensionary benefits. The supplementary affidavit so filed reflects that the ex parte decree dated 04.03.2020 was set aside by the learned Additional District Judge, 1st Court, Siliguri in Misc. Case No. 13 (05) of 2024 vide its order dated 24.12.2024.
The said changed circumstance was brought to the notice by way of a communication/representation dated 27.12.2024 to the Officer-in-Charge, Station Headquarters, 33 Corps, Sukna, Darjeeling.
In view of the communication/representation being made incorporating the changed circumstances, I direct the authorized officer to dispose of the communication/representation of the petitioner dated 27.12.2024 and inform the outcome to the present petitioner within a period of 45 days from the date of communication of this order.
Learned advocates for the petitioner and the Union of India are directed to communicate this order to the appropriate authority.
With the aforesaid observations, the writ petition being WPA 142 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.
There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
