This is an application for condonation of delay in preferring Leave to Appeal. The delay is of 123 days. The reasons so assigned by the applicant/petitioner are just and sufficient. Therefore, the delay is condoned.

Accordingly, the application for condonation of delay in preferring Leave to Appeal being CRAN 1 of 2020 is allowed. The subject matter of challenge relates to an order of acquittal passed by the learned CJM, Jalpaiguri in respect of offence under Sections 448/323/379/427/34 of the Indian

Penal Code.

Leave is granted to the applicant/petitioner to file memorandum of appeal within a period of 30 days from the date of this order.

Consequently, CRMSPL 1 of 2020 is allowed.
