The petitioner has prayed for direction upon the police to initiate an F.I.R. and start investigation on the complaint filed by the petitioner on 13th January, 2022. The Officer-in-Charge, Pundibari, Coochbehar has given instruction to the learned advocate representing the State wherein it has been mentioned that on receipt of the complaint from the petitioner, Pundibari Police Station Case No. 49 of 2022 dated 1st February, 2022 under Section 420 of the Indian Penal Code has been initiated and the same has been endorsed to LSI Pinki Roy for investigation. The investigation is proceeding and further evidences are forthcoming.

From the aforesaid instruction that has been forwarded by the Officer-in-Charge, Pundibari Police Station, it appears that the grievance of the petitioner

has already been redressed and the police case is under progress.

No further order is required to be passed in the instant writ application save and except that the police shall act strictly in accordance with law.

Writ petition stands disposed of.

Instruction given by the Officer-in-Charge, Pundibari Police Station to the learned advocate representing the State respondents be retained with the records.

Urgent Photostat certified copy of this order, if applied for, be given to the parties, after completion of all legal formalities.
