It appears that the service upon the opposite party has returned with an endorsement 'refused' which amounts to good service.

Heard learned counsel for the petitioner.

The petitioner seeks expeditious disposal of the proceeding in Title (Mat) Suit no. 263 of 2022 pending before the learned Civil Judge, Junior Division, 1st Court at Jalpaiguri.

In view of the innocuous prayer of the petitioner, the matter may be taken up for consideration even in the absence of the opposite party since none of the parties shall stand to lose if there is a direction of expeditious disposal of the proceeding pending before the learned Civil Judge,

Junior Division, 1st Court at Jalpaiguri. In fact, such order shall enure to the benefit of both the parties.

In view of the above, the application being C.O. 11 of 2024 is allowed.

The learned Civil Judge, Junior Division, 1st Court at Jalpaiguri is directed to dispose of the suit being Title (Mat) Suit no. 263 of 2022 pending before him as expeditiously as possible, preferably within one year from the next date of hearing fixed before the Court.

Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
