Briefly stated the case of the prosecution the F.I.R was lodged on the statement of the victim wherein she lodged that the petitioner was called to her house for treatment of her son and there the petitioner finding that the victim alone tried to commit rape upon her.

Charge-sheet was filed after the investigation. Learned counsel for the victim states that there was some disagreement between the parties on account of which the present F.I.R was lodged.

Perusal of the record it indicates that earlier anticipatory bail application was moved by the petitioner was rejected by this Court vide order dated 16th December, 2025 in CRM(A) 869 of 2025. The petitioner is still absconding after rejection of the anticipatory bail application. The petitioner in total disregard to the law filed the present petition for quashing, this is a sheer abuse of the process of law. The petitioner who is absconding is not entitled to any discretion from the Court. CRR 45 of 2026 is thus dismissed.
