The petitioner has approached this Court under Article 226 of the Constitution challenging the recruitment procedure of Anganwadi workers for the year 2006. Accordingly, the petitioner prayed for issuance of writ of mandamus upon the respondents directing them to conclude the selection procedure and to publish merit list-cum-panel in respect of the said examination and to fill up the vacancy on the basis of the merit. The respondent no. 7, the Child Development Project Officer, Mathabhanga -II, ICDS Project has submitted a report enclosing final list of selected candidates along with their respective numbers which they scored in the selection test. It appears from the

said report that the cut off marks for the scheduled caste candidate was 52.25 whereas the writ petitioner scored 30.50. Therefore, the writ petitioner does not come within the zone of consideration for appointment.

In view of the above discussion, I do not find any merit in the instant writ petition and accordingly, the instant writ petition is dismissed on contest, however, without cost.

The report submitted by the respondent no. 7 in the form of affidavit be kept with the record.
