Learned advocate for the petitioner submits that the copy of the writ petition has been duly served upon the private respondent nos.6 to 9. None appears on behalf of the aforesaid respondents.

Affidavit of service has however not been filed by the petitioner in proof of service.

In view of the order I intend to pass no useful purpose will be served by keeping the writ petition pending.

From the submission made on behalf of the petitioner and the documents annexed to the writ application, it appears that there is a continuing private civil dispute in between the petitioner and the private respondent. The petitioner claims that there are several civil Court orders in his favour.

The petitioner alleges that there are series of complaints and counter complaints filed by the parties before the police.

The petitioner complains that he filed several complaints before the Commissioner of Police, Siliguri Police Commissionerate but the same has not been taken into consideration till date.

Since it appears that the dispute between the parties is absolutely private in nature the Commissioner of Police suo motu shall not be entitled to enter and decide such private dispute.

The instant writ petition is accordingly disposed of by giving liberty to the petitioner to approach the appropriate forum, in accordance with law, for redressal of his grievances, if so advised.

WPA No.251 of 2020 is disposed of.

Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
