The applicant being the defacto complainant, seeks cancellation of an order dated August 28, 2020 passed by the Court of the learned Additional Sessions Judge cum Commercial Court at Siliguri, whereby the accused was granted bail. We are of the view that it will be in the fitness of things if the applicant first approaches the learned Court which passed the order of bail.

Accordingly, without going into the merits of this application and reserving liberty to the applicant to approach the learned Court which passed the bail order, we dispose of this application. Needless to say, all points sought to be urged by the

applicant in this application shall remain open before the learned Court which passed the bail order.

Accordingly, CRM 143 of 2021 is disposed of.
