Mr. Kumar Shantanu ... For the petitioner Mr. Bikramaditya Ghosh Mr. Pretom Das ... For the State The petitioner is a member of the West Bengal Health Services. He tendered his resignation on 5th November, 2018 wherein it was mentioned that his resignation would be with effect from 20th December, 2018. The petitioner is not yet aware as to whether his resignation has been accepted or not. It appears from the instruction forwarded by the Superintendent, District Hospital, Jalpaiguri, that no decision has yet been taken with regard to the prayer of the petitioner seeking resignation.

The petitioner being a member of the West Bengal Health Services, any issue relating to his service matter will be amenable before the West Bengal State Administrative Tribunal and not before this Court, at this instance.

The petitioner will be at liberty to take appropriate steps before the proper forum in accordance with law, if so advised.

Instruction given by the Superintendent, District Hospital, Jalpaiguri dated 22nd December, 2020 be retained with the record.

The writ petition is disposed of.
