The plaintiff in a suit for declaration that the order made by the District Inspector of Schools (S.E.) is illegal and for mandatory injunction has filed the instant application for expeditious disposal of the Title Suit No. 31 of 2018 pending before the Civil Judge (Junior Division), Sadar, District Cooch Behar. The plaintiffs have taken out an application for temporary injunction, which according to the petitioner, is still pending. It has been submitted by the learned advocate for the petitioner that the application for temporary injunction is pending since June 1, 2018.
It has been further submitted by the learned advocate for the petitioner that the next date fixed for hearing of the injunction application is March 15, 2021 In view of the order sought and proposed to be passed, there is no necessity of issuing any notice upon the opposite parties. However, the petitioner shall be
obliged to forward a copy of this application and this order upon the opposite parties.
Since the injunction application is pending from June 2018, C.O. 20 of 2020 is disposed of by requesting the learned Civil Judge (Junior Division) Sadar, District Cooch-Behar to take up the hearing of the application for injunction filed in connection with Title Suit No.31 of 2018 on the next date fixed, i.e., March 15, 2021, and to dispose of the same as expeditiously as possible and preferably within a period of four weeks from the next date fixed, if the same is otherwise ready for hearing.
There shall be however, no order as to the costs.
Photostat certified copy of this order, if applied for, be supplied to the learned advocate for the petitioner expeditiously on compliance of all requisite formalities.
