CRM 162 of 2021 (Through Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kotwali Police Station Case No. 88 of 2019 dated February 10, 2019 under Section 365 of the Indian Penal Code, 1860 addition Section 4 of the Protection of Children from Sexual Offences Act, 2012 and Charge Sheet No. 222 of 2019 dated May 2, 2019 submitted under Section 365 of the Indian Penal Code, 1860 adding Section 4 of the Protection of Children from Sexual Offences Act, 2012.
And In the matter of: Bablu Roy .... Petitioner Mr. Anirban Banerjee ... For the Petitioner Mr. Ujjwal Luksom, Mr. Biswarup Roy ... For the State Having regard to the period of detention already undergone by the accused and the statement of the victim girl under recorded Section 164 of the Code of Criminal Procedure and as the trial is yet to commence, we are of the opinion that the petitioner should be enlarged on bail.
Accordingly, the prayer for bail being CRM 162 of 2021 is allowed upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of like amount each, one of whom must be local subject to the satisfaction of learned Judge, Special
Court ( under the POCSO Act ), Jalpaiguri with the further conditions that the petitioner shall not intimidate, influence and tamper with the evidence and he will report to the Investigating Officer once in a week till the completion of the trial.
