IN THE HIGH COURT AT CALCUTTA

CIRCUIT BENCH AT JALPAIGURI CRIMINAL MISCELLANEOUS JURISDICTION C.R.M. (M) 26 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Bhorer Alo Police Station Case No. 338 of 2025 dated 17.12.2025 under Sections 6/14 of the POCSO Act read with Sections 78/137(2)/140(3)/123/117(2)/109(3) of the Bharatiya Nyaya Sanhita.

And In Re : Parimal Sarkar Mr. Anirban Banerjee ... For the Petitioner Mr. Kallol Acharjee Mr. Kallol Nag ... For the State Mr. Sudip Guha Ms. Ankita Nag ... For the Defacto Complainant Affidavit of service filed on behalf of the petitioner is taken on record.

The petitioner is in custody for about 30 days and prays for bail.

Learned counsel for the petitioner submits that the petitioner is the father of the principal accused with whom the victim eloped. They married subsequently and resided in the petitioner's house.

Learned counsels for the State and the defacto complainant oppose the prayer.

I have considered the material on record.

Though it is a fact that the petitioner is the father of the principal accused who has married the victim, the allegation against the petitioner is also extremely serious in nature. The victim alleges that the petitioner has ravished her in absence of the principal accused.

Charge sheet has been submitted.

Considering the gravity of the offence, prayer for bail is rejected at this stage.

Case diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
