(A) 60 of 2026 In Re : An application for anticipatory bail under Section 438 of the Code of Criminal Procedure read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kharibari PS Case No.244 of 2025 dated 02.09.2025 under Sections 14A/14 C of the Foreigners Act and Section 61(2) of the BNS.

Learned counsel for the petitioner submits that the petitioner is an Indian national and is innocent. He has been falsely implicated. No recovery has been made from him.

Learned counsel for the State opposes the prayer. The petitioner appears to be an Indian national. Though it is alleged that he is involved in manufacturing fake and forged documents in respect of Indian citizenship for several foreign nationals, no such document has been seized. The investigation held so far does not prima facie connect the petitioner to the documents seized from the arrested co accused.

Upon consideration of material on record, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, in the event of arrest, the petitioner Md. Minarul Rahaman @ Sintu be released on bail on furnishing bond of Rs.10,000/-(Rupees Ten Thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall appear before the jurisdictional Court and pray for regular bail within two weeks from date. The application being CRM (A) 60 of 2026 is disposed of.
