Affidavit of service filed by the petitioner is kept with record.

The petitioner was appointed as Assistant Teacher of North Ambari New Primary School, Cooch Behar.

On completion of 20 years of his service, the petitioner was retired from service on 31st July, 2018. On superannuation, first PPO was issued on 31.7.2018. In the meantime ROPA Rule was introduced with effect from 1st January, 2019.

Subsequently on 27.9.2021 revised PPO was issued and actual gratuity and pension were released in favour of the petitioner on 1.10.2021. Now, the petitioner is claiming interest on gratuity

as well as on arrears of pension from 31st July, 2018 till 1st October, 2021.

Considered the prayer made by the Counsel for the petitioner, this Court finds that there is a delay of more than three years in releasing the gratuity and pension of the petitioner. The petitioner is entitled to get interest on gratuity as well as on arrears of pension with effect from 31st July, 2018 till 1st October, 2021 at the rate of 10% per annum. The respondent nos. 2 and 3 are directed to release interest on gratuity as well as on arrears of pension in favour of the petitioner within four weeks from the date of receipt of this copy of the order.

WPA 199/2023 is thus disposed of.
